Working With Appeals Boards

 

   We have often helped clients appeal classifications, experience modifiers, or payroll decisions at various appeal boards.  The actual specifics of the appeal mechanism available to employers varies from state to state, but every state has appeal procedures in place for employers to dispute decisions by insurers or rating bureaus.

Often these appeal processes can be less formal and involved (and thus less expensive) than resolving such disputes through the courts.

       In states that use the NCCI as the Workers Compensation rating bureau, there are state-specific appeal mechanisms administered under the jurisdiction of NCCI.  Non-NCCI states have their own appeal mechanisms.  Even with NCCI states, there can be significant variations from state to state in the makeup of these appeal boards.    Typically, the NCCI appeal boards do not require the representation of an attorney.

Additionally, we have assisted employers to make a further appeal of an unfavorable decision by such Appeal Boards, usually to the state department of insurance.  These often do require the representation of legal counsel.
